Certificate of Trust

When you transact business on behalf of your trust, you will sometimes be asked to produce a copy of your trust document. Financial institutions, real estate companies, and others who deal with you will want proof that your trust exists, that they are dealing with the true Trustee, and that your trust gives the Trustee the power to do what the Trustee proposes to do. Instead of providing

a copy of your private trust document we ordinarily prepare a “Certification of Trust” or “Affidavit of Trust” for this purpose. We sometimes refer to these documents as “privacy affidavits.” State law provides that a third party may act in reliance upon the representations contained in a Privacy Affidavit without having to first see your private trust document.
