Guardian Nominations
Your local probate court generally will defer to your choice of a Guardian for your minor or disabled child if you make your wishes known in your Will or in a separate written instrument like a General Durable Power of Attorney. We ordinarily include your wishes for the nomination of a guardian for your minor children in your Will, and we ordinarily include your nomination of a guardian for you in a General Durable Power of Attorney.
Your nomination of a Guardian or Conservator for you may be important if someone other than your successor trustee or your agents seeks to be appointed by the court to take care of you or handle your personal affairs.
